Gina Carano’s Elon Musk-Backed Lawsuit Against Disney (And Cancel Culture) Scores Major Win

Gina Carano’s wrongful termination lawsuit against Disney and Lucasfilm, which is being funded by Elon Musk, scored a major win against the entertainment giant this week.

According to reports out of California, the court presiding over the case denied Disney’s request to toss the lawsuit filed by Gina Carano, meaning it will go to trial barring an out-of-court settlement.

“Defendants have not identified any evidence — in the Complaint or otherwise — to substantiate a claim that they employ public-facing actors for the purpose of promoting the ‘values of respect,’ ‘decency,’ ‘integrity,’ or ‘inclusion,’” California Judge Sherilyn Peace Garnett said in her decision, according to Deadline.

“Accordingly, Defendants’ invocation of the supposedly detrimental effects of Plaintiff’s ‘mere presence’ as one of Defendants’ employees lacks constitutional import… At this stage in the litigation, the Court cannot conclude, as Defendants urge it to, that Plaintiff’s continued employment by Defendants would inhibit or intrude upon Defendants’ rights to expressive association.”

As a result, Carano’s Elon Musk-backed case will go to trial unless she and the Mouse House settle out of court, which is certainly a possibility considering Carano just wants money and Disney would like to put this issue behind them.

Earlier this year, when petitioning to get the case thrown out, Daniel Petrocelli, the lawyer representing Disney in the lawsuit, said it should be tossed “on the grounds that Disney has a constitutional right not to associate its artistic expression with Carano’s speech, such that the First Amendment provides a complete defense to Carano’s claims.”

Disney, as the defendant in the suit, argues that the former MMA fighter was not wrongfully terminated because she “publicly trivialized the Holocaust by comparing criticism of political conservatives to the annihilation of millions of Jewish people —notably, not ‘thousands’” and that was the “final straw for Disney.”

The social media post at the center of the lawsuit was made by Carano on Instagram in February 2021 when she wrote on her Instagram Stories:

The post in question came in 2021 when Carano wrote a comparison between being Jewish during the Holocaust and a Republican in 2020s America on her Instagram Stories:

“Because history is edited, most people today don’t realize that to get to the point where Nazi soldier could easily round up thousands of Jews, the government first made their own neighbors hate them for simply being Jews. How is that any different than hating someone for their political views?” the outspoken conservative actress wrote.

Lucasfilm, the Disney-owned studio that produces all Star Wars projects, announced her firing from the hit Disney+ series The Mandalorian on that same day.

While Disney saw Carano’s firing as a result of her “trivializing the Holocaust,” the former Cara Dune actress said she was “consistently dehumanized” and the victim of a “bullying smear campaign aimed at silencing, destroying and making an example out of me.”

After she was fired by Disney, Carano’s was initially bullish about her career prospects, as she claimed her next project was making her dreams come true.

Since then, Carano has starred in two films produced by The Daily Wire: Terror on the Prairie and My Son Hunter (a movie about Hunter Biden). Prior to The Mandalorian, Carano had starred in films such as Haywire, Fast & Furious 6, and Deadpool.

Carano would be wise to be wary of Musk’s backing, however, as the controversial billionaire recently reneged on his promise to donate $45 million per month to Donald Trump’s presidential campaign.

As for The Mandalorian, Carano’s character Cara Dune was written out of the story, which is set to culminate in at 2026 film titled The Mandalorian & Grogu.
