Tiger Woods’ ex-girlfriend Erica Herman is not going down without a fight in her $30 million lawsuit against the 15-time Major winner.
Herman has been seeking permission from the court to speak publicly about information she says she learned about Woods before she signed a non-disclosure agreement (NDA) in 2017.
“Because of the aggressive use of the Woods NDA against her by the Defendant and the trust under his control, the Plaintiff is unsure whether she may disclose, among other things, facts giving rise to various legal claims she believes she has,” the lawsuit reads. “She is also currently unsure what other information about her own life she may discuss or with whom.”
Among that “other information” she is seeking clarity on is “information obtained after the end of her personal relationship with” Tiger Woods.
Herman also asked the court to void the entire NDA on the grounds that it is unenforceable under the federal Speak Out Act.
Herman alleges Woods committed sexual harassment while the two were dating.
Last month, Judge Elizabeth Metzger upheld the non-disclosure agreement and in an 11 page ruling opted for arbitration, as is stated in the NDA for any disputes.
On June 2, Herman asked the court to reconsider its decision, but Judge Metzger again ruled against her, shutting down Herman’s lawsuit, at least temporarily.
It was only temporary because, as USA Today now reports, Erica Herman has filed an appeal with the Fourth District Court of Appeal in Florida.
The $30 million in damages that Herman seeks comes from what she says was an oral tenancy agreement she had to stay at Tiger Woods’ home for several more years, despite the couple’s breakup.
Herman claims Woods tricked her into moving out of the home by telling her to pack some luggage for a trip to the Bahamas. However, once she reached the airport, Woods told her to speak to his lawyer, left on the plane without her and locked her out of the home.
