
A North Carolina woman who received a hit to the shoulder from a BuzzBall drink container during a game last August is now suing the Los Angeles Dodgers. She is representing herself in the lawsuit.
In the lawsuit, she claims that someone threw, dropped, or otherwise propelled a BuzzBall beverage, which comes in a round container about the size of a baseball, from an elevated seating or standing area above the woman’s seat during the game.
The BuzzBall container allegedly caused her to lose the normal use of her arm
She blames the Dodgers for negligence. She claims the BuzzBall container “struck her directly in the shoulder with significant force.” As a result of the impact, she says she suffered an injury.
According to the Los Angeles Superior Court complaint, the woman claims that the impact resulted in instant discomfort, bruising, swelling, and the loss of normal use of her arm.
She further asserts that the injury she received at the Dodgers game significantly disrupted the plans for her California visit, including a trip to Disneyland.
“As a direct result of the incident, plaintiff’s planned four-day family vacation to Los Angeles and Disneyland was substantially disrupted and deprived of its intended enjoyment,” the lawsuit reads.
The woman also claims that her two young children, who were at the Dodgers game with her, experienced “fear, shock, and emotional distress” from witnessing the BuzzBall container injure their mother.
Selling BuzzBall drinks created a ‘dangerous condition’
According to the lawsuit, the Dodgers should have anticipated that serving alcohol in “containers capable of being thrown or falling” would create “a foreseeable risk of harm to spectators.”
She alleges that the BuzzBall containers sold at the park created a “dangerous condition.” She also said that the Dodgers neglected to alert her and others about it.
In addition to demanding a “trial by jury on all issues so triable,” she is suing the Dodgers for unspecified damages. She alleges that she has endured mental and physical suffering, loss of enjoyment, and the financial burden of past and future medical expenditures related to her injuries.
The Dodgers did not comment on the lawsuit. It is their policy regarding all ongoing legal matters, according to a team spokesman.
