Most people consider themselves lucky if they order French fries at McDonald’s and they are piping hot. A New York woman is not one of those people, as she is suing McDonald’s, claiming she suffered “severe personal injuries” caused by “extremely hot” French fries.
The woman claims that her injuries occurred at a McDonald’s restaurant across the street from Bryant Park in New York, when employees there “due solely… [to] the carelessness, recklessness and negligence” … “fail[ed] to provide [her] with a safe order of fries,” according to The Independent.
She should never have been “permitt[ed] and allowed[ed]” to “be served and consume extremely hot and overheated fries,” the lawsuit claims. It also argues that “the aforesaid occurrence was due solely by reason of the Defendants’ negligence” and “through no fault or lack of care” on her part, and that she was not adequately warned of “the dangers to be encountered” while eating the French fries.
As a result of this alleged negligence, she claims she suffered mouth and tongue injuries and endured “a severe shock to the nervous system.” She also claims the hot French fries caused her to suffer “great physical pain and mental anguish,” and “was confined to bed and home and caused to abstain from usual duties and activities.”
She also alleges that these injuries “may be permanent and lasting” and that she “has been damaged in a sum which exceeds the jurisdictional limits of all lower Courts.”
McDonald’s is no stranger to lawsuits
Earlier this year, McDonald’s was named in a class action lawsuit claiming “the McRib does not contain any actual pork rib meat at all” but rather “lower-grade pork products such as … pork shoulder, heart, tripe, and scalded stomach.”
“Despite its name and distinctive shape – its meat patty has been deliberately crafted to resemble a rack of pork ribs – the McRib does not contain any actual pork rib meat at all,” the lawsuit read.
“It is precisely these misleading attributes that drive sales of the sandwich, which is why McDonald’s continues to bring it back time after time.”
Last month, a New York City tourist sued McDonald’s after being served a McMuffin they described as “wholly unfit for human consumption.”
In that case, the woman claimed the sandwich made her “violently ill and nauseated” while causing “severe pains and distress throughout her body” to the point where her “physical, nervous and mental systems were seriously and permanently injured.”
