With a lack of physical evidence, one of the strategies used by Jane Doe’s lawyers will focus on the absence of Rose’s condom.

After sex, Rose took his condom, put it back in the wrapper and took it with him “like he was never there,” attorney Waukeen McCoy said.

However, Rose’s lawyers countered by saying that is what NBA players are told to do.

NBA players are instructed to flush their condoms down the toilet or take them so women can’t use the sperm to impregnate themselves, Rose’s lawyer said.

Rose, who was traded to the Knicks this offseason, is being accused of gang-raping his ex-girlfriend with two friends. No criminal charges have been filed against Rose as of the time being.
