An Applebee's customer in California went viral after sharing how she ordered every type of Dollarita for her table.
Dollaritas, Applebee’s infamous $1 margaritas, come in all kinds of flavors. But when one California-based woman and her friends ordered every flavor to try, commenters were left clutching their pearls.
The video, which has 362,000, shows an Applebee’s waitress with a multicolored tray of Dollaritas placing all the drinks on the table for TikToker @xicanavero and her group. The on-screen text says, “We ordered every single Dollarita flavor.” Moreover, in the video description, the TikToker claimed that “we had 4 rounds of each flavor.”
BroBible reached out to the TikToker via TikTok direct message and to Applebee’s via email.
Applebees’s Dollarita: Is There A Limit?
Some commenters were concerned by the video.
“If the liquor board sees this, both that waitress and the restaurant are going to have big problems,” one wrote.
“This is illegal,” a second said.
While a third added, “OMG girl noo you can get her in so much trouble.”
Others had a more relaxed attitude.
“For people think she’s over serving you guys actually don’t know how little amount of alcohol is in these,” a fourth pointed out. “I used to work at Applebees and I promise you it’s not much.”
“Why is everyone in these comments a cop?” a fifth asked. “Good lord.”
Similarly, a sixth quipped, “Not the patrol in the comments.”
What Does The Law In California Say?
Dram shop laws determine how liable a business serving or selling alcohol is for damage or injuries caused by or to people intoxicated by its products. These laws exist at a state level, which means that each state has its own individual laws and jurisdictions.
Under California law, there is no restriction on how many alcoholic drinks can be served to individuals at any time. There is also no restriction on how much alcohol can be in these drinks. However, there are legal restrictions on Californian businesses serving an intoxicated person. According to California Business and Professions Code § 25602, “every person who sells, furnishes, gives, or causes to be sold, furnished, or given away, any alcoholic beverage to any habitual or common drunkard or to any obviously intoxicated person is guilty of a misdemeanor.”
In layman’s terms, this means that if someone at that branch of Applebee’s served those drinks to someone seriously intoxicated, they could get themselves in some serious trouble. However, the law also notes that the person who sells the alcohol can’t be held civilly liable “to any injured person or the estate of such person for injuries inflicted on that person as a result of intoxication by the consumer of such alcoholic beverage.”
So, provided the TikToker and the rest of their party weren’t intoxicated, there is nothing in Californian law to suggest that the Applebee’s server did anything wrong. Presumably, customers can get cut off at each franchise’s discretion.
