Free fountain drink refills are common at sit-down restaurants. While dining out, most people operate under this assumption, as their servers continuously top off their beverage of choice. Arizona TikTok creator Krissy (@krissy_w3) was one of them—until she noticed the hefty Diet Coke charges she and an unnamed companion racked up. Now, she’s calling out servers who fail to inform customers about this.
“If you’re a waiter or waitress and you don’t disclose to me that refills for sodas aren’t free, and you’re pouring it like water, you’re sus,” she says while sitting in her home. “I don’t care what anyone says. Maybe it’s a hot take.”
Then, she dives into her story.
“We were at dinner last night, and we both decided not to drink, so we got Diet Cokes instead,” the content creator explains. Since her server kept pouring Diet Cokes and inquiring if they wanted refills, she was under the impression the sodas were free. When she was handed the bill, she found out otherwise.
“We paid $35 in sodas. Like what? Jail,” Krissy concludes.
Needless to say, she is still fuming over the incident. “Story time slash rant because why am i finding out on the bill that the soda refills weren’t free,” the content creator vented in the caption.
But Is It A ‘Hot Take’?
Krissy’s tirade garnered over 59,000 views. Many were equally as livid on her behalf.
“That’s not a refill, that’s ‘would you like another diet coke?’” one viewer commented.
“Yea that would be grounds for no tip,” another remarked.
“Naw I’m telling the manager,” a third stated.
Even alleged servers agreed, sharing how they prevent this confusion by providing their customers transparency.
“Yeah no… this is something you tell guests about. I’ve had ppl ask me if the mocktails are refillable and it’s like obviously not?? But regular sodas duhhhh,” one server said.
“That’s CRAZY!! as a server i always distinguish purchased refills/drinks vs free(which i will just bring without saying anything),” a second revealed.

Is This Legal?
It is legal across the U.S. for restaurants to charge for refills—as long as pricing isn’t deceptive. It’s best to assume a restaurant charges for refills unless it explicitly advertises it doesn’t.
California has a “California Honest Pricing Law,” which focuses on transparency for consumers. It forces restaurants to clearly display full prices.
How To Spot A Restaurant’s Refill Policy
Because of rising costs, you might notice the extra charge on extra sauces, sides, substitutions, or even beverages. Reading a menu thoroughly can save you the unwanted surprise at payment. Grocery Coupon Guide suggests searching for these policies, like refills, in the fine print or hidden in the footnotes on the menu.
It’s always best practice to double-check with your server about these things before they refill your glass.
