A Miami man was overcharged at a restaurant after he didn't tip when he received horrible service. Should he file a police report?
Taking a picture of a receipt at the end of your meal might be one of the last thoughts you have when going out to a restaurant for dinner. More often than not, thoughts will revolve around the meal that was just consumed and if there’s room for dessert elsewhere. However, a Miami man shares why you probably should be snapping a photo of your restaurant receipt.
In a TikTok with over 23,800 views, Oscar Vidal (@ovozr) claims a Kan Sushi location in Miami overcharged him for his meal after he didn’t leave a tip.
“If you live in Miami, this is your sign to always check and always take a picture of your receipt… especially if that receipt has a tip line on it,” Vidal begins.
Vidal says a picture of his receipt saved him from getting overcharged.
Vidal admits that he didn’t tip because he believed the service was horrible.
“My bill was $68, and I did not leave a tip. I don’t care. You guys could argue with your mother,” Vidal says.
A few days later, Vidal says he checked his credit card transactions and noticed something was off.
“I see a charge for $74 from the same restaurant that I went to that I didn’t try to tip,” he shares.
Vidal says he checked the photo of the receipt he took that evening and confirmed it was not $74. Vidal says he tried to call the restaurant to address the issue but was ignored each time. The man then decided to directly go to the restaurant.
“If they don’t give me a refund, I’m gonna call the police. And I am gonna file a police report,” he says.
Did Vidal Get A Refund?
Vidal says he confronted the staff. And as soon as he mentioned the police, he says they complied.
“’Oh, that’s not necessary. It’s only $6,’” he recalls the worker saying.
“The audacity of this lady to say it’s not necessary, and it’s only $6” Vidal vents.
“This is theft. … You altered the receipt that I signed. It clearly says $0, and you decided to add $6 of extra tip into your pocket,’” he says he told them.
The restaurant agreed to refund Vidal but under one condition, according to the TikToker.
“’We’ll go ahead and refund you as long as you don’t file a police report,’” he says the worker told him.
Vidal says he got his money back, but he’s debating whether or not to still file the police report.
“I might just file a police report just for the simple fact that she told me that it wasn’t necessary to file a police report. Just because you said it was only $6. ‘Cause at this point, it’s not even about the money,” Vidal shares.
Vidal concludes the post by reminding everyone to take a picture of their receipts and to check their credit card transactions regularly.
‘File The Police Report’
Viewers in the comments section agreed it’s a matter of principle and should not be taken lightly—even if it’s only $6.
“Could’ve been 6 cents fym, that’s THEFT,” one TikTok commenter wrote.
“Could’ve been $60, $600… it’s the principle,” another added.
“It’s the principle. It’s stealing. Good for you,” a third shared.
Other viewers chimed in and advocated for Vidal to submit a police report so that this doesn’t happen to others.
“File the police report,” one commented.
“Her reaction says it happens all the time. They do this to people all the time,” another said.
“File the report and press charges. Simply because I am willing to bet they pull this stunt on all of their customers,” a third suggested.
“File it no matter what because they will do it to someone else,” a fourth wrote.
Vidal confirmed in a comment to BroBible that he did file a police report.
What Should You Do When A Restaurant Overcharges You?
Restaurants are busy environments, and mistakes can happen. If you discover you have been overcharged by a restaurant, it’s best to address the situation promptly.
My Bank Tracker notes the first thing to do is get in contact with the restaurant. Ideally the issue can be resolved over the phone, but a visit in person may need to occur to get the refund. Managers should also have the ability to provide more context into the situation and resolve it on the spot.
If the restaurant doesn’t issue a refund, the next step is to contact your bank, as the transaction can be disputed. The bank will likely issue a refund for the overcharge while they sort it out on your behalf.
Now, if you believe the charge was intentional, a police report should be filed. By doing this, an official report is recorded and can support the dispute charge case with the credit card company. If there’s a pattern of overcharging customers, the police can launch an investigation into the restaurant.
Additionally, as Vidal learned, it’s always best to keep receipts or take a photo of it for your records.
