Tiger Woods’ Ex-Girlfriend Walks Back Harassment And Abuse Claim; Her NDA Stands

Back in July, Tiger Woods’ ex-girlfriend Erica Herman dropped her $30 million lawsuit against the golf legend.

The withdrawal of the lawsuit came after a judge ruled that she must abide by the 2017 Non Disclosure Agreement (NDA) she signed before she began dating Woods.

However, despite the lawsuit being dropped, Erica Herman had already, in a separate complaint, asked the court to invalidate the entire NDA on the grounds that it was unenforceable under the Federal Speak Out Act.

The Federal Speak Out Act is a law that “prohibits the judicial enforceability of a nondisclosure clause or nondisparagement clause agreed to before a dispute arises involving sexual assault or sexual harassment in violation of federal, tribal, or state law.”

Circuit Judge Elizabeth Metzger, who ruled on Erica Herman’s NDA complaint, called her claims of sexual harassment against Tiger Woods “vague and threadbare” in her ruling.

“Herman has had the opportunity (to) provide factual specificity for any claim relating to sexual assault or sexual harassment, however, she has not done so,” Metzger wrote.

However, it took until Tuesday for Herman’s latest appeal of the Non Disclosure Agreement enforcement to be finally and permanently dismissed by order of the court.

Since Herman had cited the Federal Speak Out Act in an effort to circumvent the NDA, the damage to Tiger Woods’ reputation was already done.

Now, according to documents from the Florida’s Fourth District Court of Appeal, which were obtained by Fox News, Herman now claims that she “was never a victim of sexual harassment or sexual abuse at the hands of Tiger Woods or any of his agents and it is her position that she never asserted a claim for such.”

So not only did Herman not get anything out of her original $30 million lawsuit, she can’t even discuss anything that happened during the course of her relationship with Woods.
