Kellogg’s Is Being Sued, Again, Over The Amount Of Strawberries In Their Pop-Tarts

  • Another class action lawsuit has been filed against Kellogg’s over the amount of strawberries in their Frosted Strawberry Pop-Tarts.

Back in August, it was reported that a woman was taking Kellogg’s to court because she claimed they have been misleading consumers about the amount of strawberries in their Frosted Strawberry Pop-Tarts. She was so upset about it, apparently, that she filed a class action lawsuit against the company.

“The benefits from strawberries cannot be provided by strawberry ‘flavor,’ which refers to compounds extracted from strawberries used solely for taste, without their nutritional value,” stated her class action lawsuit.

Prior to that, a man named Kelvin Brown also sued Kellogg’s because the labeling on their strawberry Pop-Tarts contains images of fresh strawberries, but they also allegedly contain dried pears and apples.

“Consumers do not expect a food labeled with the unqualified term ‘Strawberry’ to contain fruit filling ingredients other than strawberry, and certainly do not expect pears and apples, as indicated on the back of the box ingredient list,” Brown’s class action lawsuit stated.

And now, once again, Kellogg’s is being sued, this time by a New York woman named Elizabeth Russett, over, you guessed it, the amount of strawberries in Kellogg’s Whole Grain Frosted Strawberry Pop-Tarts.

TMZ, who obtained a copy of the class action lawsuit, reports Russett is suing Kellogg’s because “the fruit filling in Kellogg’s Whole Grain Frosted Strawberry Toaster Pastries is mostly other fruits.”

According to the lawsuit, obtained by TMZ, the Pop-Tarts in question are actually heavier on pears and apples than strawberries … which she insists is not enough to provide the berry’s nutritional benefits, let alone a strawberry taste.

Russett claims Kellogg’s is using their packaging to fool folks who want a snack packed with more strawberries … she says the damages exceed $5 million and also wants to see Pop-Tarts labeled more accurately.

Seems reasonable.

Maybe while they’re at it, Kellogg’s can do something about fixing the amount of berries consumers should expect to be in Kellogg’s Mixed Berry Breakfast Bars and the amount of vegetables in their Morningstar Farms brand products like their Veggie Burgers, Veggie Dogs and Veggie Chik’n.
