New Jersey Man Sues Jersey Mike’s And Grubhub After Finding Teeth In His Cheesesteak Sandwich

A New Jersey man has filed a lawsuit against Jersey Mike’s, Grubhub and the delivery driver after finding a set of teeth in his cheesesteak sandwich.

Rodriguez ordered the cheesesteak sandwich from a Jersey Mike’s location in Lacey Township, Ocean County, New Jersey using the Grubhub app in April 2025.

According to the lawsuit filed on May 28, 2026, in Middlesex County by Bayville resident Fernando Rodriguez, the cheesesteak “appeared packaged and sealed with scotch tape” when it was delivered. However, upon closer inspection with the wrapping removed, he “discovered foreign objects, specifically dentures, embedded within the sandwich.”

Rodriguez then went to the Jersey Mike’s restaurant with the sandwich and the dentures to ask for an explanation. Court documents claim that the dentures belonged to the Grubhub delivery driver.

After police arrived at the eatery, officers questioned the Jersey Mike’s owner and contacted the driver. At first, she allegedly said her father had been dining at the restaurant and that the dentures were his.

After police reported that she made some “completely outlandish statements,” she eventually acknowledged that the dentures were hers. She informed investigators that she had “accidentally placed her dentures in Fernando’s sandwich” while checking to ensure Rodriguez’s order was correct and while eating her own lunch.

Finding the teeth in the sandwich was ‘shocking and offensive’

Police did not bring criminal charges against anyone, but Rodriguez is now suing the delivery driver, Grubhub, and Jersey Mike’s.

The discovery of the dentures in his cheesesteak sandwich, according to the suit, caused Rodriguez “extreme shock, disgust, emotional distress, nausea, loss of appetite, and physical revulsion.”

“Finding a foreign object that came from another person’s mouth, in direct contact with a sandwich, is not only shocking and offensive, but raises serious concerns about contamination and food safety,” said Rodriguez’s attorney Ian Goldman.

The lawsuit accuses the delivery driver of “tampering” with the cheesesteak, Grubhub of negligence in training and hiring of employees, and Jersey Mike’s of failing to “properly package, seal, and secure food.”

A Grubhub spokesperson told the New York Post that the company was “troubled by this report, as it doesn’t reflect the high standard of service our customers expect.” They also confirmed that “the individual in question is no longer contracted to deliver with Grubhub.”

Jersey Mike’s did not immediately respond to the Post’s request for comment, and they could not reach the delivery driver.
