Woman Ticketed In Florida For Driving While Holding Cell Phone In Hand She Does Not Have

There’s being stubborn, and then there’s going too far.

A woman was given a ticket for holding her phone in her right hand while driving in Florida. Just one problem. She doesn’t have a right hand.

Making matters even worse for the officer, the woman posted the police bodycam footage of her traffic stop, in which she challenges the Palm Beach County Sheriff’s Deputy’s claim, in a TikTok video that has since gone viral.

According to the citation, the officer observed her holding a handheld device while she was driving northbound on North Dixie Highway. The deputy claims to have seen the device in her “right hand” during the stop. The woman contests the ticket, pointing out that she does not have a right hand.

And, again, making matters worse, according to Attorney Ted Hollander with the Ticket Clinic, who spoke to CBS 12 News about the case, “Whether she’s holding it in her right hand or her left hand, it really doesn’t matter. If you are not in a school zone or a construction zone, you are allowed to hold a cell phone. The fact that neither [the school zone nor construction zone box] is checked off tells me that this did not occur in one of those zones.”

In the video, the woman explains to the deputy that he must have been mistaken, for more than obvious reasons. “So, you want to just call this a day?” she asked.

The deputy still gave her a ticket. He just couldn’t take the L and move on.

She fought the law and the law lost

“So a lot of times people pay tickets that shouldn’t be paid, and this could have been one of those examples,” Hollander continued. “But luckily, this lady seems to be standing up for herself.”

Indeed she did.

She scheduled a court hearing for Tuesday and fully intended to contest the ticket. Instead, CBS 12 News reports, court records show that the Palm Beach County Sheriff’s Office deputy who issued it requested the citation be dismissed.
